    TOOVEY v TOOVEY.
    In this matter, the Crown Solicitor Intervened to show cause why the decree nisi, which had been granted, should be rescinded and the suit dismissed.
    The petitioner was Olga May Toovey (formerly Messenger), and the respondent, Frederick Albert Toovey.
    The petitioner was granted a decree nisi in June, 1932, and the Crown now alleged that, since the granting of the decree nisi, the petitioner had committed adultery with one James Edgar. This was denied by Mrs. Toovey, who asked that the decree be made absolute.
    The petitioner and respondent were mar-ried on April 23, 1924, at Sydney, according to the rites of the Church of England.
    His Honor found in favour of the Crown.
    [rescinded the decree nisi, and dismissed the petitioner's petition. No costs were allowed.
    Mr. B F. F. Telfer (Instructed by Mr. J. S. Harnett, of the Crown Solicitor's office) appeared for the Crown; and Mr. Stewart Jamieson (instructed by Mr. J. K. Cutler) for Mrs. Toovey.
